Penrod William Keith
Penrod W. Keith is a shareholder with Dentons in Salt Lake City is the current chair of its Restructuring, Insolvency and Bankruptcy group. He focuses on representing creditors and debtors in bankruptcy cases, as well as bankruptcy-related litigation. He also represents clients in alternative debtor/creditor arrangements such as state and federal receiverships, assignments for benefit of creditors, state law dissolutions and forbearance agreements. Mr. Keith’s past representations include advising clients and fiduciaries, including trustees, debtors and committee members with respect to their rights, duties and obligations in bankruptcy and receivership cases and proceedings. He has advised clients on the interactions of tax law, environmental law and other laws with federal bankruptcy law, representing clients in identifying tortious behavior in entities involved in restructuring or dissolution proceedings and advising clients with respect to sales transactions. Mr. Keith has been active in the bankruptcy community and in continuing legal education forums, including at various times serving as the chair of the UtahState Bankruptcy section, working as a contributing author and researcher on the Collier’s bankruptcy treatises, and participating with the Practicing Law Institute and ABI as a lecturer and committee member on various task forces and presentations. He has represented trustees and debtors in all aspects of bankruptcy cases, including litigation, sale procedures, environmental issues and claims, tax issues and appeals in bankruptcy matters, privacy advice and privacy ombudsmen, and Ponzi scheme identification and prosecutions, including multiple case consolidations litigation. He has successfully defended clients in preference and fraudulent transfer litigation. He also has provided advice on maximizing returns to creditors in such cases. Mr. Keith’s clients have included those involved in mining and oil and gas cases, real-estate specific representations including the impact of federal law on leases, steel production and fabrication industries, mass-tort cases, financial and insurance restructurings, and health care cases He has been listed in The Best Lawyers in America and Super Lawyers, and he is rated AV-Preeminent by Martindale-Hubbell. He also is chair of the Utah State Bar’s Bankruptcy Section. Mr. Keith received his B.A. in 1983 from Brigham Young University and his J.D. magna cum laude in 1986 from BrighamYoung University’s J. Reuben Clark Law School.
