Donald W. Fitzgerald

Donald W. Fitzgerald is a partner with Felderstein Fitzgerald Willoughby & Pascuzzi LLP in Sacra- mento, Calif., and has more than 30 years of experience providing legal representation in all phases and types of chapter 11 proceedings, business restructurings, corporate insolvencies and out-of-court loan workouts. He regularly serves as counsel for debtors in possession, trustees, creditors' committees and landlords in complex chapter 11 cases, and he has particular expertise in the agriculture, food processing and real estate industries. Mr. Fitzgerald has represented purchasers of assets in business reorganizations and wind-downs, and is also experienced in representing lenders in bankruptcy courts on matters includ- ing cash collateral, post-petition financing, relief from stay, lien avoidance and contested confirmation hearings, and in such nonbankruptcy matters as administering to the foreclosure of real and personal property and documentation of out-of-court workouts. Mr. Fitzgerald is a Fellow of the American Col- lege of Bankruptcy, is AV-rated by Martindale-Hubbell and is regularly recognized in Northern Califor- nia Super Lawyer (2005-present) and in The Best Lawyers in America (2006-present), which named him the "Sacramento Bankruptcy and Insolvency Lawyer of the Year" (2013). Mr. Fitzgerald is a member of the Bars of California and Arizona, is a former officer (1987-89) and president (1990) of the Sacramento County Bar Association's Bankruptcy and Commercial Law Section, and was was a board member of the California Bankruptcy Forum (1998-2001). He is also an active panel member of the Eastern District of California's Alternative Dispute Resolution Program and speaks frequently to bar groups and profes- sional associations on bankruptcy and workouts. Mr. Fitzgerald received his B.A. from the University of California, Davis and his J.D. with high distinction from the University of Arizona, where he was a member of the Order of the Coif.
