Autumn D. Spaeth is a partner with Smiley Wang-Ekvall, LLP in Costa Mesa, Calif., and concentrates her practice on business litigation and insolvency matters. She specializes in bankruptcy-related litiga- tion, including the prosecution and defense of fraudulent conveyance, preference and nondischargeabilty actions. She is also experienced in receiverships and assignments for the benefit of creditors. Ms. Spa- eth's practice includes a broad range of business-litigation matters in state and federal court, including partnership disputes, prosecution and defense of claims for breach of guaranty, breach of fiduciary duty and unfair business practices, as well as intellectual property infringement litigation. Her clients include businesses and their principals, chapter 11 debtors, chapter 7 and 11 trustees, creditors, assignees for the benefit of creditors and receivers. Previously, Ms. Spaeth was an associate in the Trial Department of McDermott, Will & Emery and a partner at Weiland, Golden, Smiley, Wang Ekvall & Strok, LLP be- fore joining Smiley Wang-Ekvall, LLP when it formed in 2014. She holds an AV peer-review rating by Martindale-Hubbell and has twice been named one of the Five Top Bankruptcy Attorneys by O.C. Metro Magazine. She co-authored "Who Is the True Borrower? An Analysis of the Sham Guaranty Defense Reveals a Broad, Fact Intensive, and Total Defense to Deficiency Actions," published in the California Bankruptcy Journal for the 2012 California Bankruptcy Forum. Ms. Spaeth received her undergraduate degree in political science from the University of California Los Angeles, her M.A. in communication management from the University of Southern California Annenberg School, and her J.D. from the Uni- versity of Southern California Law School, where she was notes editor of the Southern California Law Review and served as a research and teaching assistant to Prof. Erwin Chemerinsky.
